Don Jones, whose company 123 Careers is in a legal dispute with ABC Learning over the right to supply relief staff, has said he is considering shutting the 15 centres he owns before December 25.

Ms Gillard, who is responsible for child care as part of her education portfolio, said on Tuesday no childcare centre can legally close without giving at least 30 days notice.

She said Mr Jones' comments were inflammatory and should be viewed in the context of him being caught up in a legal battle with ABC Learning.

"To the extent that Mr Jones has sought to frighten people by seeming to suggest that centres could close overnight, that cannot happen, it will not be happening and I think Mr Jones should, really, be more cautious in his language," she told Sky News.

"(Parents) are obviously worried and I think Mr Jones being out there trying to give the impression that centres could close overnight is really very unfair to the anxious mums and dads."

When asked whether she was worried about revelations clerical staff are caring for children in ABC Learning centres, Ms Gillard said concerned parents should contact the federal government's Child Care Access Hotline on 1800 670 305.
